The following terms apply to all orders placed on theblackmountain.com.

We invite you to read them carefully: by completing an online transaction, you agree to these terms and conditions.

Pricing and Taxes

The prices displayed on theblackmountain.com do not include sales taxes or shipping fees. Black Mountain collects the applicable taxes based on the shipping address provided. GST, HST, or provincial sales taxes will be calculated at checkout. 

The following tax rates apply: 

  • GST (5%) is charged on all orders across Canada, except in the following provinces where HST is applied: 
  • Nova Scotia: 15% 
  • Ontario, New Brunswick, Newfoundland and Labrador: 13% 
  • In Quebec, a provincial sales tax (QST) of 9.975% is also added to each order. 

If you return an item, the taxes paid on that item will be refunded. However, taxes paid on shipping and handling fees are not refundable, as these costs are non-recoverable once the package has been shipped.

Indigenous Sales Tax Exemption

In accordance with federal and provincial regulations, individuals with Indigenous status under the Indian Act may be eligible for a sales tax exemption on online purchases, provided the following conditions are met: 

  • You meet the government criteria for tax exemption 
  • The items are shipped to a reserve 
  • A signed copy (front and back) of your Certificate of Indian Status is sent by email to service@theblackmountain.com 

If any of these conditions are not met, the applicable sales taxes will be charged. 

Shipping

Black Mountain is committed to delivering your order to a Canadian address, according to the shipping method selected.

Order Processing and Shipping

We do our best to ship orders quickly, in the order they are received. However, delays may occur due to unforeseen circumstances or factors beyond our control.

Accuracy of Information

Black Mountain strives to ensure the accuracy of the information displayed on theblackmountain.com, but we cannot guarantee that all details are error-free. 

Despite our continuous efforts to keep our website up to date, some information may contain errors or omissions, particularly regarding product descriptions, prices, or availability. Offer dates, prices, or product availability may change without notice. 

We make every effort to only present available items and keep our inventory accurate. However, it is possible that a product, size, or colour may be out of stock when you place your order. Once your order has been processed, you will receive a confirmation email including the estimated delivery date, availability, and price of each item ordered. 

In some cases, we may need to cancel an order if, for example, an item cannot be shipped due to an unforeseen issue. 

We reserve the right to correct pricing or description errors, even after an order has been confirmed, and to refuse or cancel any order based on incorrect information.

Product Condition

We make every effort to present the items on our website as accurately as possible. However, we cannot guarantee that the colours displayed on your screen will match the actual product, as this can vary depending on the device. 

If a product has a manufacturing defect or appears to have been damaged during shipping, you can return it for free by following the instructions on our returns portal.

Purchases made on theblackmountain.com must be returned by mail, following the indicated procedure. They cannot be returned or exchanged at physical retailers of the brand.

Modifying or Cancelling an Order

You can review and modify the contents of your shopping cart as many times as you like, as long as you have not clicked "Checkout" to complete billing, shipping, and payment.

Once your order is finalized, it cannot be cancelled or modified.You will need to wait until your package arrives and then return the items by mail, following the provided return procedure.

Black Mountain guarantees a full refund for any item returned in accordance with its return policy.

Limits

Black Mountain reserves the right to refuse any order placed on theblackmountain.com for any reason deemed reasonable.

At our discretion, we may limit or cancel quantities purchased per person, household, or order. This may include orders placed from the same customer account, with the same credit card, or using the same billing or shipping address.

If an order is modified or cancelled, we will attempt to notify you via email, to the billing address, or by phone using the contact information provided during purchase.

We also reserve the right to limit or block any orders that, in our judgment, appear to be placed for resale purposes by a merchant, distributor, or reseller.
